TERMS AND CONDITIONS OF SALE

1. Introduction

This document governs the terms and conditions of use of the site and the purchase of ALMAGIOIELLI branded products, registered trademark no. 302025000003279, owned exclusively by Mikkel S.R.L.

Accessing the site and purchasing products imply full acceptance of these Terms and Conditions.

Any unauthorised use of the name, logo, images, text, design, packaging, multimedia content or other distinctive elements infringes applicable intellectual property law.

3. Products

The products sold include jewellery, costume jewellery and fashion accessories, personalised and non-personalised.

Product images are for illustrative purposes. Slight variations in colour, shape or finish are normal and do not constitute a defect, as they result from the craft process and the materials used.

4. Orders

By placing an order, you confirm that the information you provide is complete, correct and truthful.

Alma Gioielli may refuse or cancel an order:

  • if the details supplied are incomplete or incorrect;

  • if fraudulent activity is suspected;

  • if there is an obvious error in price or description.

In such cases we will inform you and, if payment has already been taken, refund the full amount.

5. Prices and payment

Prices are shown in the currency displayed on the site and at checkout, and include VAT where applicable.

Payment is taken at the time of the order using the methods shown on the site (cards, PayPal, instalment options and other available systems).

If there is an obvious pricing error, Alma Gioielli may cancel the order and issue a refund.

6. Production, shipping and delivery

Production and shipping methods and times are governed by the Shipping Policy, which forms an integral part of these Terms.

We make your piece in 5 to 9 working days, followed by 2 to 4 working days for delivery.
In exceptional cases, delivery may take place within a maximum of 30 days from the date of purchase. If we cannot deliver within that period, you are entitled to cancel the order and receive a full refund.

The risk of loss or damage to the goods passes to you on delivery.

7. Cancellation and returns

Cancellation rights are governed by the Returns Policy, which forms an integral part of these Terms.

In summary:

  • the right to cancel applies only to non-personalised products;

  • personalised products are excluded from the right to cancel, because they are made to your specification, under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;

  • for non-personalised products, the right to cancel must be exercised within 14 days of receiving the item.

This does not affect your rights if an item arrives faulty, damaged or different from what you ordered.

8. Your rights if something is wrong

Every item we sell is covered by your legal rights under the Consumer Rights Act 2015. Goods must be of satisfactory quality, fit for purpose and as described. If they are not:

  • you can reject the item and get a full refund within 30 days of receiving it;

  • after 30 days you can ask us to repair or replace it;

  • if a repair or replacement is not possible, you can ask for a price reduction or a refund.

In addition to your legal rights, we offer a 2 year commercial guarantee against manufacturing faults. This guarantee is additional to your rights under the Consumer Rights Act 2015 and does not replace or limit them.

Neither your legal rights nor our commercial guarantee cover:

  • normal wear and tear;

  • accidental damage;

  • improper use or use not in line with the care instructions;

  • unauthorised modifications or repairs.

9. Limitation of liability

Alma Gioielli is not responsible for:

  • damage caused by improper use of the products;

  • individual allergic reactions to materials, it being your responsibility to check compatibility;

  • disruption or delay caused by circumstances outside our direct control.

Nothing in these Terms limits or excludes any statutory rights you have as a consumer, and nothing here excludes our liability for death or personal injury caused by our negligence, or for fraud.

10. Intellectual property

All content on this site is the exclusive property of Mikkel S.R.L. or of the respective rights holders.

Any unauthorised reproduction, distribution or use, even in part, is prohibited.

11. Governing law and jurisdiction

These Terms and Conditions are governed by Italian law. This does not affect the rights you have as a consumer under the law of the country where you live, including, if you live in the United Kingdom, the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For disputes with consumers, the courts of the place where the consumer lives have jurisdiction.

12. Changes to these Terms

Alma Gioielli may amend these Terms at any time.
Changes take effect from the date they are published on the site and do not apply to orders already confirmed.
